The Service Provider is exempt from VAT, therefore the prices indicated do not include VAT and the Service Provider does not charge VAT.

2. Scope and acceptance of these Terms

These Terms of Service (hereinafter: the Terms) set out the conditions for using the services provided by the Service Provider on the opusnumerology.com website and in the applications belonging to it.

By registering or by ordering any service, the User declares that they have read and understood these Terms and accept them as binding upon themselves. The contract is concluded in the Hungarian language, qualifies as a contract concluded by electronic means, and does not qualify as a contract put in writing; the Service Provider does not file it and it is not accessible afterwards.

The service is available exclusively to persons who have reached the age of 18.

3. Content and nature of the service

The Service Provider provides computer-generated written analyses based on a numerological and Chinese astrological approach, using the data supplied by the User.

Important warning. The service is provided for informational purposes only. The analyses do not constitute lifestyle, legal, financial, business, relationship, medical or any other health-related advice, may not be regarded as an expert opinion, and do not replace consulting a qualified professional. The User uses the application and its content entirely at their own risk and is solely responsible for any decisions made on the basis of the analyses.

The analyses are produced with the involvement of generative artificial intelligence. The Service Provider does not warrant the accuracy or completeness of the analyses, or their fitness for any particular purpose.

4. Registration and user account

Using the service requires registration, for which the User must provide their e-mail address, password, full birth name and date of birth. After registration, the Service Provider sends a confirmation e-mail; the account becomes active by opening the link contained in that e-mail. Without confirmation, the service cannot be used.

The free personality analysis and the complimentary credits granted upon registration are available once per combination of birth name and date of birth. If a free analysis has previously been created for the same name and date, the account is still created and can be used without restriction, but the complimentary package cannot be granted again.

The User is responsible for the truthfulness of the data provided and for keeping the login details of their account secure. The Service Provider is not liable for any damage arising from the unauthorised use of the password by a third party.

Registration is free of charge. Following registration, the User receives their personality analysis in three styles free of charge, together with 3 complimentary credits.

5. Credit system and prices

Use of the service is credit-based. One credit entitles the User to one analysis, as follows:

The available credit packages and their prices:

Prices are stated in US dollars and do not include VAT (exemption from VAT). Purchased credits do not expire and cannot be exchanged for money. Credits are not transferable to other persons.

The Service Provider reserves the right to modify prices and the composition of the packages. Such modifications do not affect credits already purchased.

6. Ordering, payment and invoicing

The User selects the desired credit package in the Shop menu. The order can be completed on the secure payment page of the payment service provider.

Payments are handled by Stripe Payments Europe, Ltd. Accepted payment methods: bank card, Apple Pay, Google Pay. The Service Provider does not receive or store bank card details.

Purchases are available exclusively to private individuals; purchases by companies (with a tax number) are not possible. For invoicing, the User must provide their name and billing address.

Following successful payment, the Service Provider issues an electronic invoice, which the User receives at their registered e-mail address. The purchased credits are added automatically to the User's balance once the successful payment has been confirmed.

7. Performance

The service qualifies as digital content that the Service Provider does not supply on a tangible medium. Credits are added immediately after payment, and the analyses are produced immediately at the User's request, using the credits.

If an analysis is not produced due to a technical error, the system automatically returns the deducted credit to the User's balance.

8. Right of withdrawal and refunds

Under Government Decree No. 45/2014 (II. 26.) on the detailed rules of contracts between consumers and businesses, the consumer is, as a general rule, entitled to a 14-day right of withdrawal without giving reasons.

Under Section 29(1)(m) of the referenced Decree, the consumer may not exercise their right of withdrawal in respect of digital content supplied on a non-tangible medium if the Service Provider has begun performance with the consumer's express prior consent, and the consumer, at the same time as giving that consent, acknowledged that they lose their right of withdrawal once performance has begun.

By purchasing credits, the User expressly consents to the Service Provider beginning performance (the crediting of the credits) immediately, and acknowledges that by doing so they lose their right of withdrawal in respect of the credits used.

Discretionary refund

Notwithstanding the above, the Service Provider voluntarily undertakes to refund, on a discretionary basis, the value of unused credits where a request is submitted within 14 days of the purchase. In such cases, the refunded credits are deducted from the User's balance.

A refund may be full or partial: in the case of a partial refund, the Service Provider refunds the value of the number of still unused credits indicated in the request, at the per-credit price applicable in the given package.

The refund procedure:

The Service Provider may refuse a discretionary refund if the credits have been used, if the request is received after the 14-day deadline, or if the User has used the service contrary to its intended purpose or in an abusive manner.

The above does not affect the statutory rights relating to defective performance (warranty for defects).

9. Obligations of the User

The User undertakes to use the service lawfully and for its intended purpose. The following are prohibited in particular:

The Service Provider is entitled to restrict the access of, or terminate the account of, any User who breaches this section.

10. Liability

The Service Provider provides the service "as is". Given the informational nature of the service, the Service Provider excludes liability for any damage arising from the content of the analyses, their interpretation or any decisions made on their basis, save for those areas of liability that cannot be excluded by law.

The Service Provider is not liable for any downtime caused by reasons beyond its control (in particular, faults attributable to internet service providers, hosting providers, payment service providers or artificial intelligence providers). The Service Provider strives to ensure continuous availability but does not guarantee it.

11. Intellectual property

The application, its visual identity, its source code and the methodology applied are the intellectual property of the Service Provider. The User may freely use their own analyses for private purposes, but may not exploit them commercially.

12. Data processing

The processing of personal data is governed by the Privacy Notice, which forms an inseparable part of these Terms.

13. Complaints handling and enforcement of rights

The User may submit complaints to info@opusnumerology.com. The Service Provider will examine the complaint and provide a substantive written response within 30 days.

Conciliation board

If a complaint is rejected, the consumer may turn to a conciliation board. The board with jurisdiction based on the registered seat of the Service Provider is:

The Service Provider has an obligation to cooperate in conciliation board proceedings.

Consumer protection authority

The consumer may submit consumer protection complaints to the metropolitan or county government office with jurisdiction over their place of residence.

Online dispute resolution

The European Commission's online dispute resolution platform is available at the following address: https://ec.europa.eu/odr

The consumer may also enforce their claim through the courts.

14. Amendment of these Terms

The Service Provider is entitled to amend these Terms unilaterally. The amended Terms enter into force upon publication and apply to orders placed after their entry into force. The Terms in force at any given time are continuously available on the website.

15. Governing law

In matters not regulated in these Terms, Hungarian law applies, in particular Act V of 2013 on the Civil Code, Act CLV of 1997 on Consumer Protection, Act CVIII of 2001 on Electronic Commerce Services, as well as the provisions of Government Decree No. 45/2014 (II. 26.).
